PIL in High Court seeks contempt action against Maharashtra CM, Sena’s Sanjay Raut, and others

A public curiosity litigation (PIL) has been filed within the Bombay Excessive Court docket searching for the initiation of contempt of courtroom proceedings in opposition to Maharashtra Chief Minister Uddhav Thackeray, state house minister Dilip Walse Patil, Shiv Sena MP Sanjay Raut, and others for allegedly passing remarks in opposition to the judiciary.

The petition filed by the Indian Bar Affiliation claimed that the respondents holding ministerial positions have levelled a number of “false, scandalous and contemptuous” allegations in opposition to the judges of the Excessive Court docket and the whole judicial system.

“This has been carried out to undermine the majesty and dignity of the courtroom and to shake the religion of the frequent man in the direction of judiciary, which is the grossest contempt of the courtroom,” the plea stated.

The PIL has additionally sought contempt motion in opposition to Rashmi Thackeray, editor of ‘Saamana’ newspaper (Shiv Sena mouthpiece) and spouse of Uddhav Thackeray, and Vivek Kadam, the printer and writer of ‘Saamana’.

“The respondents/contemnors, who’re holding ministerial berths and are in energy are concerned in a marketing campaign of scandalizing the whole judicial system solely as a result of judgments rendered by courts don’t swimsuit them,” the PIL stated.

“Their (respondents) plan to maintain their opponents in jail or to trigger them harassment by the misuse of energy and police equipment are failed because of the orders of this Court docket and the Supreme Court docket,” it alleged.

The petition is scheduled for listening to on April 26.

The PIL listed numerous situations whereby feedback had been purportedly made in opposition to the judiciary together with the latest remark made by Raut after the excessive courtroom granted interim safety from arrest to BJP chief Kirit Somaiya in a dishonest case.

After the order, Raut allegedly gave interviews and made scandalous statements that the judges of courts, notably the Bombay Excessive Court docket, are granting reliefs to BJP members and never granting reduction to the accused ministers of their events, the petition stated.

“The contemnors are shouting in opposition to the judges of the Bombay Excessive Court docket by citing the narrative that the courts are granting reliefs to individuals belonging to BJP however the identical reliefs are usually not being granted to accused ministers, members and leaders of their celebration,” the PIL stated.

It additional stated that the judges are beneath great stress since each order handed by them is being scanned and defamed by the contemnors.
