Anushka Sharma had filed two petitions by way of her taxation guide difficult orders handed by the Deputy Commissioner of Gross sales Tax, Mazgaon, asking for dues for 2012-13 and 2013-14 evaluation years. 

The bench of Justices Nitin Jamdar and Gauri Godse stated, “These petitions are filed by way of the taxation guide of the petitioner (Anushka Sharma). There isn’t any motive proven as to why the petitioner can not file these petitions on solemn affirmation.”

The court docket requested Anushka Sharma’s advocate Deepak Bapat whether or not the Bombay Excessive Court docket Authentic Aspect Guidelines present for submitting petitions by way of a tax guide. Bapat stated that these petitions will likely be withdrawn and filed once more with Anushka Sharma signing them. 

The petitions that have been disposed of by the court docket have been related, besides for his or her challenges relating to the evaluation years. The court docket was irked that the petitions have been filed by the taxation guide and never the actor herself. 

“The Writ Petitions are accordingly disposed of with liberty to the Petitioner to file Petitions afresh on the Petitioner’s personal affirmation,” the court docket added. 

Sharma’s petitions said that she had carried out in movies and award features as per a tri-party settlement together with her agent Yashraj Movies and producers and occasion organisers. The assessing officer levied taxes not on the consideration she obtained however for endorsement of merchandise and anchoring award features. The gross sales tax, inclusive of curiosity, amounted to Rs 1.2 crore for 2012-13 and Rs 1.6 crore for 2013-14. 

The assessing officer erroneously held that by endorsing merchandise and remaining current at award features, she acquired copyrights that are liable to five per cent tax. She argued that the copyrights of the movies all the time stay with the producer. “Performer’s rights usually are not copyrights and performer’s rights usually are not able to being transferred to every other particular person,” the petitions said.
